This Privacy Notice (the “Notice”) explains why and how PayFacto Payments inc. and its affiliates (“PayFacto”) collect, use, share, store, transfer, and protect your personal information when you use our websites, as more fully described hereunder.  

This Notice applies to the main website of PayFacto, as well as to the websites of any PayFacto affiliate such as https://maitredpos.co.ukhttps://maitredpos.comhttps://payfacto.com/https://velocehq.comhttps://azbarplus.com, (collectively, the “Website(s)”). This Notice does not cover the personal information collected in our payment or point of service products and services. To read the privacy notice related to these products and services, click here. 

For the purposes of this Notice, “personal information” means information that can identify an individual directly or indirectly 

1. What personal information do we collect

The type of personal information that may be collected through our Websites includes but is not limited to: 

  • Contact information such as your name, residential address, phone number, email address – we use this to communicate with you. 
  • If you have an account with us, you may be asked for certain information to verify your identity, such as your date of birth, government identification, employment, and information about financial accounts. 
  • Employment information, such as name, residential address, phone number, employment history, CV, cover letter, and education. Employees at PayFacto are required to complete a criminal record check. If you are selected, you will be required to complete a criminal record check. 
  • Information about how you use our Websites – we use this to provide them to you and to maintain their security. We also use this information to better understand your needs and preferences (including through data analytics), to personalize your experience on our Websites, and to provide you with tailored communications and offers. 
  • Any other information you voluntarily provide us, our service providers or our contractors. 

We only collect and process your personal information when we have a valid legal basis to do so.Depending on the circumstance, we may rely on your consent or the fact that the processing is necessary to fulfill a contract with you, to comply with law, or because we have legitimate interests.  

When you use our Websites, we collect your personal information for the following purposes: 

  • to contact you when you submit a form through our Websites; 
  • to provide you with information about products and services, that have been requested by you and/or that PayFacto believes may be of interest to you and provide value to you; 
  • to analyze your candidature when you submit it to one of our career opportunities; 
  • to interact with users on social media; 
  • to analyze performance and gather analytics on our Websites, including by understanding how you interact with our Websites, and where improvements can be made; 
  • to conduct interest-based advertising by leveraging cookies, and measure the effectiveness of our ads; 
  • to fulfill any other purpose for which you provide it or with your consent 

Personal information may be collected in a number of ways, including: when you use our Websites, submit a form, and when you authorize third parties to disclose personal information to us. For example, if you post a review, make a comment, or otherwise submit personal information on a public forum such as social media accounts or public forums on our Websites or other applications, your communications may be viewable by the public. 

If you provide information about a third party or authorize a third party to do so, we will assume you have taken proper measures to obtain informed consent. 

As part of our Websites, we leverage cookies and tracking technologies for essential features, for specific functionalities, analytics and marketing purposes. Below is a description of the different types of cookies we use.

The information is then used to evaluate your use of the website and compile statistical reports on website activity. This information is made available to us in an aggregated and anonymous form; we cannot track you directly. We also use Meta Pixel to help us understand how you interact with our Websites to enable effective advertising. 

PayFacto may share your personal information with third parties to support with providing our services, administering our business, and for such other purposes as set forth below, including: 

  • Affiliates. To assist us with offering the best services to you, we may share your personal information with our other companies and respective affiliates.   
  • Employees. While performing their duties, our authorized employees may have access to personal information and other confidential information.  Employees may only access personal information strictly necessary to perform their duties.  All employees that are likely to have access to personal information must sign a Code of Ethics under which they commit to maintaining their confidentiality.   
  • With third-parties and service providers. We may disclose personal information to certain third-parties and service providers retained by us, to assist in providing you with our Websites and their functionalities, or to perform certain specialized services to assist us in our business. 
  • We only disclose to these providers the specific information they require to perform the services. Before we release any personal information to them, each of our providers must undertake to use the information solely to carry out the services they have been retained to provide, must agree to safeguard and respect the confidentiality of the information, and must agree to contractual terms that are consistent with our Notice. Third-parties and service providers must also comply with applicable privacy laws. 
  • Transfers of Business. As we continue to grow, we may expand or sell our businesses or part of it. In such a case, the personal information we hold may be among the assets transferred.  
  • We may also disclose personal information in situations where we are legally required or permitted to do so. These situations may include criminal investigations, government tax reporting requirements, court orders, or instances where we believe the rights and safety of others may be at risk. We may be ordered by a court to disclose personal information to a third party or to the court, or to preserve personal information pending the outcome of a legal hearing. We may also be legally required to disclose information in connection with the collection or repayment of a debt, to assist in the prevention of fraud or other criminal activity, when we obtain legal advice from a lawyer, or in an emergency that affects the health or safety of an individual. 

 

In the instances described above we may be required to share your personal information with or without your consent. In limited circumstances, we may be legally prohibited from advising you that your information was shared in this way. 

To ensure that your personal information is protected, we utilize security safeguards that are on par with industry standards. We keep electronic files in a secure environment with restricted access and use. All employees, third-parties and service providers are expected to maintain the confidentiality of personal information. 

Despite the foregoing security measures, online storage and online communications can never be entirely secure. We encourage all individuals to provide only the information they are comfortable with providing a third party, keep watch for communications that are suspicious, and report any suspicious activity to us as soon as possible.  

We keep your personal information for as long as it is needed to fulfill the purposes for which it was collected, or a longer period if permitted or required by law.  When no longer needed, personal information is destroyed or disposed of using secure methods.   

Please note that if your personal information is collected by a third party, it will be kept in accordance with the privacy policies requirements of that third party. 

Your personal information may be stored by PayFacto in locations outside your province, territory, state, or country of residence. PayFacto may also subcontract the processing of or share your personal information with third parties located elsewhere, including locations outside your province, territory, state, or country of residence. In such cases, we will ensure that your personal information is transferred to countries that have received an adequacy decision from the competent authority, or that your personal information is adequately protected by appropriate technical, organizational, contractual, or legal means. 

Depending on the jurisdiction in which you are located, you may benefit from different rights over your personal information, such as: 

  • The right to access your personal information and obtain information about the purposes of collection and who it is shared with. 
  • The right to request the rectification of your personal information if it’s incomplete or inaccurate. 
  • The right to request the deletion of your personal information, in certain circumstances. 
  • The right to obtain a copy of your personal information in a structured and interoperable format for its transfer to a third party. 
  • The right to restrict the use of your personal information if you are concerned about the accuracy of the personal information or how it is used. 
  • The right to object to the processing of your personal information, in certain circumstances. 
  • The right to file a complaint with your local privacy regulator. 

 

If you decide to exercise your rights, we may require that you confirm your identity with us. You can exercise your rights by contacting us with the contact information of the Privacy Officer below. Your rights are subject to applicable legal restrictions. We will respond to your request within a reasonable timeframe and in compliance with applicable laws. 

We may modify this Notice from time to time, such as to reflect new laws, or changes to how we process personal information. We will try our best to notify you, but it’s always a good idea to check the latest update date of this Notice from time to time, and review its content. Modifications to this Notice take effect at the date indicated at the top of the Notice.
